We want to build long-term relationships, so we aim for complete transparency with our terms of business.

General

R Costings aim is to build up a long term relationship with you, so please do not hesitate to contact us with any queries regarding our terms of business.

Performance

R Costings will provide suitably qualified personnel to carry out the work and will carry out the work using reasonable skill and care and in accordance with accepted professional standards. Free door to door file collection and return using our own in-house couriers, otherwise DX. We will provide a competitive turn around with files.

Checking bills

It is the Client’s responsibility to check Bills of Costs before passing to a third party, including their Clients.

Fees

Fees to be agreed with the client at the outset will be charged on an hourly rate or fixed fee basis to be agreed. Travel time will be charged on an hourly rate or fixed fee basis, plus all reasonable travel expenses, including daily subsistence and hotel expenses. Invoices will be rendered as and when each specific instruction has been completed and must be settled within timescales agreed with client. R Costings reserves the right to charge interest at 8% over base rate in the case of overdue accounts. All fees shall include any applicable VAT.

Professional indemnity

R Costings maintains Professional Indemnity Insurance. The liability of R Costings for any breach of this Agreement, or arising in any other way out of the subject-matter of this Agreement, will not extend to any incidental or consequential damages or losses or any loss of profits, loss of data, loss of contracts or opportunity. In any event, the maximum liability of R Costings to the Client under or otherwise in connection with this Agreement or its subject-matter is equal to the total of the sums payable by the Client under his Agreement. Nothing in this Agreement is intended to exclude or restrict any liability of R Costings in respect of death or personal injury cases by its negligence.

Termination

The Client may terminate instructions to us in writing at any time. Work completed up to the date of notice of termination will be invoiced for all works carried out.

Third parties

R Costings may be required to engage a third party on your behalf (e.g. Barrister). R Costings cannot accept any responsibility for any act or omission of a third party unless otherwise agreed.

Force majeure

If R Costings’ performance of the work is delayed or prevented by circumstances beyond its reasonable control, then R Costings will use all reasonable endeavours to resume performance as soon as possible, but will not be in breach of this Agreement because of any delay in performance.

Confidentiality

R Costings will keep information passed to it, confidential and will not knowingly, nor intentionally disclose it to any third parties, unless authorised by the Client or as required by law. R Costings will not breach this obligation to the extent the confidential information which is disclosed or becomes publicly known without the fault of R Costings. Files will be shredded after expiry of 6 years from archive.

Data protection

R Costings Ltd is committed to privacy for everyone. Under the Data Protection Act 1998, we must comply with certain requirements which are designed to ensure that any Data you provided to us is processed with due care and attention. Our Privacy Policy is tailored to comply with the General Data Protection Regulation ((EU) 2016/679) (GDPR).

Rights of third parties

For the purpose of the Contracts (Rights of Third Parties) Act 1999, we agree that no term of this Agreement with you is enforceable by a Third Party.

Law

A contract between R Costings and the Client will be governed under English Law.
